V&M Agency provides AI automation, digital marketing, website development, lead capture, and creative content services for construction and trades businesses. Specific services, deliverables, timelines, and pricing will be outlined in individual service agreements or proposals provided to each client.

3. SMS Messaging Terms & Compliance

3.1 Program Description

V&M Agency's SMS messaging program sends appointment confirmations, reminders, follow-up messages, and service-related communications to customers and prospects who have opted in to receive messages through our website, contact forms, or chat widget.

3.2 Opt-In & Consent

By providing your mobile phone number and submitting a contact form, booking a call, or engaging with our chat widget, you expressly consent to receive SMS text messages from V&M Agency. You are not required to consent to receive SMS messages as a condition of purchasing any services.

3.3 Message Frequency

Message frequency varies depending on your interactions with us. You may receive messages related to appointment scheduling, appointment reminders, follow-ups on inquiries, and service updates. Typical frequency is between 2–6 messages per month, but may be higher during active service engagements.

3.4 Message & Data Rates

Message and data rates may apply. Check with your mobile carrier for details about your plan's SMS rates.

3.5 Opt-Out Instructions

You may opt out of receiving SMS messages from V&M Agency at any time by replying STOP to any message you receive from us. After opting out, you will receive one final confirmation message and no further SMS messages will be sent to your number. To re-subscribe, text START to the same number.

3.7 No Sharing of SMS Data

Your mobile phone number and SMS opt-in data will not be shared with third parties or affiliates for any marketing or promotional purposes.

All content, designs, and materials created by V&M Agency on behalf of a client become the client's property upon receipt of full payment, unless otherwise specified in a written agreement. V&M Agency retains the right to display completed work in its portfolio unless the client requests otherwise in writing.

All original content on this website — including text, graphics, and the V&M Agency name and logo — is the property of V&M Agency and may not be reproduced without written permission.

6. Limitation of Liability

V&M Agency provides services on an "as-is" basis and makes no guarantees regarding specific results, including lead volume, revenue, or conversion rates. Our liability for any claim arising out of or related to our services shall not exceed the total amount paid to us by you in the three (3) months preceding the claim.

V&M Agency shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of our services.

7. Third-Party Platforms

Our services may involve third-party platforms including but not limited to GoHighLevel, Google, Meta, and others. V&M Agency is not responsible for changes in the terms, policies, functionality, or availability of these third-party platforms.

8. Payment Terms

Payment terms, amounts, and schedules are specified in individual client agreements. Failure to make timely payment may result in suspension of services. All fees are non-refundable unless otherwise specified in a written agreement.

9. Termination

Either party may terminate a service agreement with written notice as specified in the individual client agreement. Upon termination, all outstanding payments become immediately due. V&M Agency reserves the right to terminate services for any client who violates these terms or engages in unlawful conduct.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Wayne County, Michigan.

12. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective upon posting to this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
